Buying procedure

According to actual laws, there is no restriction for buying estates in Montenegro. Every foreign client can become owner of an estate (house, apartment, ...) in Montenegro, the same way as the resident. The only difference is in case of buying land without built objects. In that case it is necessary to register the company that will become the owner of the land by the time of building the objects. From that time, ownership can be transferred to the individual and it is a simple procedure.

If you have found a property that satisfies all your criteria and wish to buy it, the first step is to make a deposit. It obliges the Seller to stop offering his property in the market. Signing of a pre-contract to protect both the Seller and the Buyer is the legal background of that step. If the Buyer decides not to buy the property, his deposit shall not be returned. If the Seller changes his mind about selling his property or if there is anything wrong with the papers, such as mortgaged property or unresolved property relations, the Buyer shall receive his deposit back doubled.

The pre-contract should further include an agreed time limit for signing of a final contract, i.e. the actual date.

All documents must by verified by the competent Court confirmed with stamp and signature.

After conclusion of the final contract, the property shall be officially registered in the name of the new owner. The Buyer shall be obliged to pay a property excise tax equaling 2% of the market, i.e. assessed property value to the competent tax authorities.
